Elderly woman sues after being fined $5860 for missing final $436 payment
A US woman billed $US5800 ($5860) after missing the final payment on her 30-year mortgage can pursue a lawsuit against the debt collectors.

Lawyers for Dorothy Rhue Allen, 85, say the fees charged by two banks and a law firm violate consumer-protection laws. The suit says LaSalle Bank and Cenlar Federal Savings Bank started foreclosure proceedings in 2007 after the hospitalised Allen missed the last $US432 payment on her home in Deptford, New Jersey.

The banks advised her lawyers she could pay $US5800 to avoid foreclosure. Her lawyers instead sued over the fees and the foreclosure action was dropped.

A US appeals court this week said she could pursue her case, reversing the decision of a federal judge who threw it out.

Kudos to the appeals court for this ruling. Sometimes the good guys win.
